If you own a property with a swimming pool or spa in NSW, there are a few important rules to keep in mind:

Certificates You Need

  • Every pool or spa must have either a valid certificate of compliance, a certificate of non-compliance, or an occupation certificate issued within the last 3 years. It also needs to be registered.

Selling a Property?

  • If you’re selling and can’t get a certificate of compliance, you can pass the responsibility to the buyer. This happens by attaching a certificate of non-compliance to the sale contract. But keep in mind—most buyers won’t agree to this, so you’ll likely need to get that compliance certificate before settlement.

Got a Certificate of Non-Compliance?

  • You’ve got 90 days from the date it was issued to fix any defects listed and get a certificate of compliance.

Special Rules for Strata or Community Titles

  • Different rules apply if your property is part of a strata or community title. Check what applies to you.

Leasing Out Your Property?

  • As a landlord, you must ensure the pool or spa has both a certificate of registration and a certificate of compliance. Again, different rules may apply for strata or community titles.

Getting a Certificate of Compliance

  • You can get one from your local council or an independent accredited certifier registered with the Building Professionals Board. There will be a fee, and you can find accredited certifiers on the Swimming Pool Register website.

  • Don’t wait until the last minute! Around 95% of pools fail the first inspection, and it can take up to 90 days to fix everything and pass.

  • To prepare, check your council’s website—most have a guide to help you sort out common issues before the inspection.

Not Sure if You Have the Right Certificates?

  • You can check online! Head to the NSW Swimming Pool Register website and use the “Lookup Pool” tool.

  • Enter your street number and name (skip adding road, street, lane, etc.) and your suburb.

  • Hit “Find Property”—if your pool has a valid compliance certificate, the address will show up.

 

Staying on top of these requirements not only keeps your pool safe but also avoids any headaches when selling or leasing your property!
